New Labor Law Posting Requirements

 On August 30, the National Labor Relations Board (NLRB) issued a final rule creating a new posting requirement for virtually all private-sector employers (excluding agricultural, railroad, and airline employers). The poster notifies employees of their rights under the National Labor Relations Act (NLRA), such as the right to form a union, bargain collectively, discuss terms and conditions of employment with coworkers, the right to strike, and the right to engage in other protective activities. The poster also includes a list of illegal practices in which employers and unions are prohibited from engaging, and also provides information on filing a claim along with NLRB contact information.

 
The effective date for this rule is November 14, 2011.

Both union and non-union employers are required to post the notice. If employers regularly communicate with employees via an intranet or internet site, they are required to distribute the poster electronically as well as post it physically. Failure to post will be treated as an unfair labor practice. If 20 percent of the workforce is not proficient in English, employers must also post the notice in the language the employees speak.
